Oasis – Terms & Conditions and Community Guidelines

1. Acceptance of Terms
By downloading, installing, accessing, or using the Oasis mobile application (“App”), operated by MyOasis NZ Limited (“Oasis”, “we”, “us”, “our”), you agree to these Terms and Conditions and the Community Guidelines (collectively, “Terms”). If you do not agree, do not use the App.
2. Trial Status; Experimental Features
The App is currently in trial (beta) status. Features, user interface, functionality, reward mechanics, and services may change, be limited, interrupted, degraded, or discontinued without notice. Use of the App during the trial is at your own risk.
3. Eligibility
You must be at least the minimum legal age required in New Zealand to form a binding contract. By using the App, you represent and warrant that you meet this requirement.
4. Account and Registration
You may need to create an account and provide accurate, current, and complete information. You are responsible for protecting your login credentials and all activity under your account. Notify us immediately of any unauthorised use.
5. Community Guidelines
5.1 No Tolerance for Objectionable Content
Oasis enforces a strict zero-tolerance policy for objectionable, harmful, or illegal content. Violation may result in content removal, account suspension, or a permanent ban.
5.2 Prohibited Content and Behaviour
You must not post, share, or engage in:
Hate speech or discrimination
Harassment, threats, or bullying
Nudity or sexually explicit content
Violence, self-harm, or promotion of dangerous activities
Illegal activities or promotion of illegal services
Spam, scams, or intentionally misleading content
5.3 Respectful Use
You agree to:
Treat all users respectfully
Share only lawful, appropriate content
Follow all local laws and regulations
5.4 Reporting, Moderation & Enforcement
Users may report inappropriate or abusive content or behavior.
Oasis reviews reports and may remove content or restrict/ban accounts.
We aim to review and act on reports within 24 hours.
5.5 Blocking and Safety Tools
Users may block others to prevent further contact and hide their content. If you feel unsafe, use the block and report functions immediately.
6. Rewards; Best-Effort Access
6.1 Best-Effort Availability
The App provides access to rewards offered by participating venues and partners on a best-efforts basis. We do not guarantee the availability or redemption of any specific reward.
6.2 Venue Responsibility
Reward terms, availability, redemption requirements, and expiration are determined by participating venues and may change without notice. Oasis is not responsible for acts or omissions of participating venues, including refusal to honour rewards or limited inventory.
7. Data Collection, Use, and Sharing
7.1 Types of Data Collected
We collect personal data necessary to operate the App, including:
Name, age/date of birth, gender
Location data
Social media profile information
Device identifiers, usage data, and transaction history
7.2 Use of Data
We use your data to operate and improve the App, deliver rewards, personalise your experience, communicate with you, and perform analytics and research.
7.3 Sharing and Disclosure
We do not sell or distribute your personal data except:
With your explicit permission
With participating venues/partners for reward fulfilment and validation
With service providers bound by confidentiality
As required by law or legal process
7.4 Aggregated / De-identified Data
We may use or share anonymised or aggregated data that does not identify you for analytics, research, or commercial purposes.

8. User Content and Conduct
You are responsible for all content you submit. You grant Oasis a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display your content as needed to operate the App. You must not submit unlawful, harmful, abusive, or infringing content.
9. Intellectual Property
All content, designs, text, graphics, trademarks, logos, and software in the App are owned or licensed by Oasis. You may not copy, modify, distribute, sell, or lease any part of the App unless expressly permitted by Oasis in writing.
10. Third-Party Links and Services
The App may include links to third-party services or offers. Oasis is not responsible for third-party actions, content, or policies. Your interactions with third parties are solely your responsibility.
11. Disclaimers; No Warranty
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TRIAL STATUS MAY RESULT IN BUGS, ERRORS, OR UNEXPECTED BEHAVIOR.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OASIS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND PARTNERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES. OASIS’S AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE GREATER OF: (A) AMOUNTS PAID BY YOU TO OASIS IN THE PREVIOUS 12 MONTHS, OR (B) NZD 150.
13. Indemnification
You agree to indemnify and hold harmless Oasis and its personnel from claims, losses, liabilities, damages, and expenses (including legal fees) arising from your use of the App or breach of these Terms.
14. Termination
We may suspend or terminate your access at any time, with or without cause or notice. Provisions that naturally survive termination will remain in effect.
15. Modifications to Terms
We may modify these Terms at any time. Continued use of the App after updated Terms take effect constitutes acceptance.
16. Governing Law and Dispute Resolution
These Terms are governed by New Zealand law. Any dispute will be resolved in New Zealand courts unless otherwise agreed in writing.
17. Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in full force.
18. Entire Agreement
These Terms, together with referenced documents (including the Privacy Policy and Community Guidelines), constitute the entire agreement between you and Oasis.
