Terms & Conditions

  1. Acceptance of Terms by downloading, installing, accessing, or using the Oasis mobile application ("App"), operated by MyOasis NZ Limited ("Oasis", "we", "us", "our"), you agree to these Terms and Conditions ("Terms"). If you do not agree, do not use the App.
     

  2. Trial Status; Experimental Features You acknowledge and agree that the App is in trial (beta) status. Trial status means the App, its features, functionality, user interface, reward mechanics, and related services are experimental and may change, be limited, interrupted, degraded, or discontinued at any time without prior notice. Use of the App during the trial is at your own risk.
     

  3. Eligibility; You must be at least the minimum legal age required in New Zealand to form a binding contract to use the App. By using the App you represent and warrant that you meet this requirement.
     

  4. Account and Registration; You may be required to create an account and provide accurate, current, and complete information. You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately if you suspect unauthorised use.
     

  5. Rewards; Best-Effort Access a. The App provides access to rewards offered by participating venues and partners. Access to rewards is provided on a best-efforts basis. We do not guarantee that any specific reward, reward level, or reward availability will be accessible at any time. b. Reward terms, availability, redemption requirements, and expiration are determined by the participating venues and may change without notice. c. We are not responsible for any acts or omissions of the participating venues in relation to the rewards, including refusal to honor a reward, limited inventory, or changes in venue policy
    .

  6. Data Collection, Use, and Sharing. a. Types of Data Collected: To operate the App and provide rewards, we collect personal data you provide or generate through use of the App, including name, age (or date of birth), location data, gender, and social media profile information, as well as device identifiers, usage data, and transaction history where applicable. b. Use of Data: We use collected data to operate and improve the App, validate and deliver rewards, personalise your experience, communicate with you, and for analytics and research. c. Sharing and Disclosure: We will not distribute, sell, or share your personal data with external parties except:

    • with your explicit permission;

    • with participating venues and partners as necessary to fulfill, track, validate, or manage rewards;

    • to service providers engaged to perform functions on our behalf who are contractually bound to keep your information confidential; or

    • as required by law, court order, or to respond to lawful requests by public authorities. d. Aggregated/De-identified Data: We may use or share anonymised or aggregated data that does not reasonably identify you for analytics, research, or commercial purposes. e.   7. User Content and Conduct; You are responsible for all content you submit through the App. You grant Oasis a non-exclusive, worldwide, royalty-free right to use, reproduce, modify, and display content you provide as necessary to operate the App and provide services. You agree not to submit unlawful, abusive, infringing, or harmful content or otherwise engage in prohibited conduct.
     

  8. Intellectual Property; All content, designs, text, graphics, trademarks, logos, and software provided in the App are owned or licensed by Oasis. You may not copy, modify, distribute, sell, or lease any part of the App or its content except as expressly permitted by Oasis in writing.
     

  9. Third-Party Links and Services; The App may contain links to third-party services, websites, or offers. We do not control third parties and are not responsible for their actions, content, or policies. Interactions with third parties are solely between you and the third party.
     

  10. Disclaimers; No Warranty TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL CONTENT AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. USE DURING THE TRIAL PHASE MAY INVOLVE BUGS, ERRORS, OR UNEXPECTED BEHAVIOR.
     

  11. Limitation of Liability; TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL OASIS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP OR REWARDS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OASIS'S AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID OASIS IN THE PRIOR 12 MONTHS, OR (B) NZD 150 (or the local currency equivalent).

  12. Indemnification; You agree to indemnify, defend, and hold harmless Oasis, its officers, directors, employees, agents, and partners from and against any claim, loss, liability, damage, cost and expense (including reasonable attorneys' fees) arising from your use of the App, breach of these Terms, or violation of applicable law.
     

  13. Termination; We may suspend or terminate your access to the App at any time, with or without cause, and without prior notice. Upon termination, your rights under these Terms cease. Sections that by their nature should survive termination will survive.
     

  14. Modifications to Terms; We may modify these Terms at any time. We will provide notice of material changes as required by law. Continued use of the App after such changes constitutes acceptance of the updated Terms.
     

  15. Governing Law and Dispute Resolution; These Terms are governed by the laws of New Zealand. Any dispute arising from these Terms or your use of the App will be resolved in the courts located in New Zealand, unless otherwise agreed in writing.
     

  16. Severability; If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in full force and effect.
     

  17. Entire Agreement These Terms, together with any documents they reference (including the Privacy Policy and Acceptable Use Policy), constitute the entire agreement between you and Oasis regarding the App.

By using the App you acknowledge that you have read, understood, and agree to these Terms and the Privacy Policy.
